Covers you and one other person within your household, as a passenger or driver in any car up to 3.5 ton, when either towing or not towing a horse trailer, for roadside assistance and recovery if required even when empty.

Member:
The person named in the document and one other named person living at the same address, as drivers or passengers.
Eligible Car/Trailer:
Any motor car or horse trailer which does not exceed 3500kg and the named members are drivers or passengers.
Membership:
Your membership lasts for one year from and inclusive of the date specified in the documents.
Your membership is valid upon payment of our annual membership fee. Upon renewal of your Equine Rescue Services membership, the services that you receive will be those set out in the Terms and Conditions of Membership current at the time of such renewal.
General Data Protection Regulation:
You will be required to give Equine Rescue Services permission to store and process your personal data, solely for the administration of your membership and the provision of our breakdown and recovery services you have requested. We do not store or process children’s personal data, consequently you will be asked to confirm that you are over 18 years of age. We will not pass your details on to third parties.
Law and Jurisdiction:
Your Equine Rescue Services Membership is governed by the laws of England.
We/Us/Our:
The assistance service which is operated by Equine Rescue Services and by any authorised employees or agents operating on behalf of Equine Rescue Services Ltd.
Territorial Limits:
The United Kingdom of Great Britain and Northern Ireland.
Period of Membership:
12 Months from the commencement date shown in the Schedule.
Call Outs:
This membership is limited to no more than 6 call outs in any one membership year.
Breakdown:
Mechanical or electrical breakdown (failures or breakages), flat batteries, punctures, lack of fuel, lost ignition keys or damage which is caused by an accident, vandalism or theft and results in you not being able to drive your car/trailer.
Home:
The address last notified to us as the place where the car/trailer is normally kept within the territorial limits.
Horses:
Means up to three horse(s) being transported by your car/trailer.
The Service:
Equine Rescue Services provides the following services:
- • Roadside Assistance.
- • Recovery.
- • Home Service.
- • Overnight livery and accommodation.
Assistance not covered by the terms of your membership will be provided but the Member will remain responsible for all charges.
General Conditions
- We will only provide the benefits described in the membership if you have met all the terms and conditions in this document and if the information you have given to us is correct and complete. If you have failed to give us complete and accurate information or have not met the terms and conditions, this could lead to you being charged for the full cost of the breakdown(s).
- This membership only applies to the people named in the membership and cannot be transferred to anyone else.
- If a breakdown occurs (whether or not you need immediate service), you must immediately tell the Rescue Control Centre.
- Roadside assistance or recovery will only be provided if you or the driver stays with the car/trailer until a rescue vehicle arrives.
- If assistance is provided which you or anyone acting on your behalf knows is false, fraudulent or exaggerated, you will be charged the full breakdown costs and the membership will be ended.
- You must take all reasonable steps to prevent a breakdown, and your car/trailer must not be driven in an unsafe or unroadworthy condition or until recommended repairs have been carried out.
- Tyres must be maintained in accordance with the law and the manufacturer's servicing guidelines.
- You must keep your car/trailer properly maintained and serviced in accordance with manufacturer’s recommendations.
- We will not make a refund if you cancel your membership during the membership year, except if you have cancelled within the first 14 days from inception of your membership, and only providing you have not used our services.
- You will be required to reimburse to us within 30 days from date of our invoice for any parts, costs or expenses paid out on your behalf and which fall outside of the terms of membership. Failure to do so may affect your ability to access the service.
- If you fail to pay any outstanding fees, under the terms of membership we will take legal action against you to recover the funds. Interest will be added monthly.
- If you need to contact us about any changes, please call our membership team during office hours on 01300 348997.
- Following a tyre blow out, we will fit your spare wheel unless the tyre is not serviceable or accessible or you request a new tyre to be supplied and fitted.
- New tyres are charged out at a premium rate. We recommend you carry a serviceable spare wheel and tyre.
- You must carry and have available for the technician any special tool or equipment needed to remove the wheels. We will not be held responsible for damage caused to wheels and trims as a result of locking devices not being readily available.
- The cost of parts/tyres that are given at roadside or on the phone by our staff or contractors at the time of the breakdown are estimated prices only and cannot be guaranteed.
- If we are called out repeatedly for the same fault and in our opinion you cannot provide proof that sufficient action has been taken to rectify the fault, we retain the right to charge you the full cost of the incident.
- If your car/trailer is recovered by us to our agents premises for storage we will pay storage fees for the first 24 hours only. Any charges thereafter will be chargeable.
- KEYS – We cannot provide replacement keys or auto locksmith services under your membership. In cases where a key is lost or broken, and which causes the car to be immobilized, we will only offer to recover your car to a repairer of your choice or home. Where keys have been locked inside we will use a reasonable attempt to gain access and recover the keys. If this is not possible we will recover your car/trailer to a repairer of your choice or home.
General Exclusions
Your Membership does not cover the following:-
- If the car/trailer is recovered by sea or air, any amount which is more than the cost of taking the car/trailer to the nearest port or airport.
- Any ferry fares or toll fees or congestion charges.
- Broken glass, including windscreens, is not covered by this membership.
- The cost of taking the car/trailer and its passengers to more than one address after any one breakdown.
- The cost of recovering the car/trailer, horse(s) and its passengers if the car/trailer can be repaired within a reasonable period of time at or near the place where it has broken down.
- The cost of any parts, components or materials used to repair the car/trailer, such as tyres.
- Any costs or expenses for any service, which is not arranged by the Rescue Control Centre.
- Any recovery charges apart from recovery to the nearest available garage if the car/trailer breaks down at your home or within one mile of your home.
- Breakdowns occurring if the car/trailer is carrying more people or horse(s) than it is designed to carry.
- Any costs or expenses if the car/trailer is being used for private hire, public hire, racing, rally, or in any contest or speed trial or any rigorous reliability testing.
- Any costs or expenses if the car/trailer is inaccessible or is immobile off road or cannot be reached due to snow, mud, sand or flood.
- Any costs or expenses if the breakdown is covered by any other insurance or recovery service.
- Loss of or damage to the car/trailer or its contents, or any valuables, horse or animal carried in the car/trailer.
- Any breakdown or recovery from an MOT Station or trade premises.
- No more than 6 call outs in any one membership year.
- If the Eligible Car and/or Trailer is damaged either internally or externally by a horse(s) we will provide assistance but we will invoice you retrospectively. We may agreed to invoice your insurance company directly if relevant.
The Service
We will provide breakdown assistance for your motor car or trailer both solo and combined and accept the reasonable costs involved with the breakdown, which occur during the period of membership as long as the appropriate membership fee has been paid.
Roadside Assistance
We will arrange help at the scene of the breakdown and will pay call out fees and labour charges needed to start the Eligible Car/Trailer. This benefit if designed to cover small emergency repairs. It will not cover the cost of any parts or materials. Any work which is not carried out at the roadside is not covered. This work is provided under a separate contract between yourself and the garage.
Recovery
If the Eligible Car/Trailer cannot be repaired at the scene of the breakdown, we will arrange and pay the reasonable cost of taking the Eligible Car/Trailer, horse(s), you and up to 4 passengers from the place where the Eligible Car/Trailer has broken down to any one place of your choice.
Home Service
If the car/trailer breaks down at your home or within one mile of your home, we will arrange assistance and pay call-out fees and labour charges needed to start the car/trailer. If the car/trailer cannot be repaired at the scene of the breakdown, we will pay the reasonable cost of taking the car/trailer to the nearest available garage.
Alternative Travel or Overnight Hotel Accommodation
If the car/trailer cannot be repaired at the roadside or at a garage local to the breakdown scene the same day, we will refund the cost of alternative travel arrangements or necessary emergency overnight accommodation for horse(s), you and up to 4 passengers. The most we will pay will be up to £250 for:
- Alternative road, rail travel or horse trailer hire to allow you and you party to reach your destination and return; or
- One night’s hotel accommodation for you and up to 4 passengers, including stabling costs for horse(s). (The amount we will refund will only be for the rooms) we will not pay any amount for meals or drinks.
Before you arrange alternative travel you must call the Rescue Control Centre for their agreement. We will only refund amounts covered by the membership if we receive valid invoices and receipts.
Horses
- Equine Rescue Services will arrange and pay reasonable costs for the onward transportation of you and your horse(s).
- We reserve the right to refuse to transport horse(s) if a valid horse passport is not being carried or that if in the opinion of our incident managers or contractors a horse is unfit to be transported safely for whatever reason or if DEFRA have restricted the movement of horses at any given location at the time of the incident.
- Your horse(s) are only eligible for onward travel if the registered car/trailer they are being carried in breaks down and cannot be repaired at the roadside within a reasonable time.
- It is your responsibility to ensure that Equine Rescue Services or its contractors are aware of any special requirements or instructions relating to the loading and transportation of your horse(s) prior to their movement.
- In the unfortunate event that the member has been injured or hospitalised as a result of a riding accident or road traffic accident and are unable to continue with their journey, Equine Rescue Services will arrange and pay reasonable costs for the transportation of your horse(s) back to your yard or any other single destination within the UK.
- If your horse/animal is being transported by one of our authorised horse transporters and damage to the transporters vehicle is caused by your horse/animal(s). You are solely responsible for the full cost to repair the damage caused.
IMPORTANT NOTICE RELATING TO TYRES
About a third of all the breakdowns we attend are tyre related. We strongly recommend that you carry a legal, serviceable, and easily accessible spare wheel on board, or at least a spare rubber (just the actual tyre). If carrying just the rubber you will need to make us aware that this is the case.
If you are not carrying a spare, as detailed, above we will attend and supply you with a new tyre roadside.
Tyres supplied roadside will be considerably more expensive than the price you will pay your local supplier, and in many cases the price could be double.
Like others in our industry we have no influence over the price of tyres supplied to our service, and we will only pass on the cost of the tyre, including associated parts such as valves, tubes, disposal fees, etc with no mark up.
